This Copyright & Takedown Policy explains the rules that apply to copyrighted materials and other content uploaded, stored, or shared through HitCue.
HitCue is a platform that may host or process user-submitted content, including scripts, notes, recordings, and related materials. Users, not HitCue, are responsible for the content they upload and use through the service.
1. User Responsibility
You are solely responsible for all content you upload, submit, store, share, process, or make available through HitCue.
By using HitCue, you represent and warrant that:
- you own the content you upload, or have all rights, licenses, consents, and permissions necessary to use it through the service;
- your use of the content does not infringe copyright, neighboring rights, database rights, trademark rights, privacy rights, contractual restrictions, or any other third-party rights;
- you are authorized to submit the content for cloud storage, automated processing, and AI-assisted analysis where those features are used.
- if you share content, invite links, recordings, notes, or other materials with collaborators or cast members, each recipient is authorized to receive, access, and use that material.
If you upload or process content without the required rights or permissions, you are solely responsible for the consequences, including claims, damages, losses, and legal proceedings arising from that conduct.
2. Prohibited Content
You may not upload, store, transmit, share, or process through HitCue:
- copyrighted scripts, recordings, texts, or other protected materials without authorization;
- content that violates intellectual property rights or confidentiality obligations;
- unlawful, fraudulent, defamatory, abusive, or otherwise illegal material;
- invite links, shared materials, or access credentials with persons who are not authorized to receive the relevant content;
- content submitted in breach of contracts, production rules, licensing terms, or other access restrictions.
3. No Pre-Screening or Preventive Review
HitCue does not pre-screen, verify, review, or legally assess all user-uploaded content before it is stored, processed, or made available through the service.
The fact that content can be uploaded, stored, or processed through HitCue does not mean that HitCue has reviewed it, approved it, or confirmed that the user has the rights to use it.
4. Reporting Copyright Infringement
If you believe that content available through HitCue infringes your copyright or other intellectual property rights, you may send a notice to: support@hitcue.app
Your notice should include, at a minimum:
- identification of the copyrighted work or other protected material claimed to be infringed;
- identification of the allegedly infringing content, with enough detail for us to locate it;
- your name and contact information;
- a statement explaining why you believe the use is unauthorized;
- a statement that the information in your notice is accurate to the best of your knowledge and that you are entitled to act on behalf of the relevant rights holder, where applicable.
Incomplete, unclear, or unsupported notices may delay review or prevent action.
5. Takedown and Enforcement Actions
If we receive a complaint, allegation, or other information suggesting that content may infringe rights or violate law or our terms, we may take any action we consider reasonably necessary, including:
- removing or disabling access to the content;
- suspending processing, sharing, or storage of the content;
- requesting additional information from the reporting party or the user who uploaded the content;
- suspending or terminating the responsible account;
- preserving relevant information where reasonably necessary for legal, security, or evidentiary purposes.
6. Immediate Removal and Discretion
HitCue reserves the right to remove or disable access to content immediately, with or without prior notice, where we believe this is appropriate to protect rights holders, comply with law, reduce legal risk, preserve platform integrity, or protect the service or third parties.
We may act on a complaint, legal notice, internal review, automated signal, or other information suggesting a potential violation. We are not required to wait for a court order before taking action where we reasonably consider action appropriate.
Any decision to remove, retain, restrict, or restore content is made at our sole discretion, subject to applicable law.
7. Repeat or Serious Violations
Users who repeatedly upload infringing or unlawful content, or who commit a serious violation, may have content removed, features restricted, or accounts suspended or terminated without further warning.
8. Platform Limitation of Responsibility
HitCue is an intermediary platform and does not claim ownership of user-uploaded content.
To the maximum extent permitted by applicable law:
- HitCue will not be liable for user-uploaded content, including its legality, accuracy, ownership, licensing status, or permissibility;
- HitCue will not be liable for infringement committed by users through content they upload, store, share, or process;
- HitCue will not be liable for unauthorized use, copying, forwarding, redistribution, or further disclosure of content by persons to whom you grant access or send invite links;
- HitCue will not be liable for losses arising from the removal, disabling, restriction, or unavailability of content in response to copyright or legal complaints, suspected infringement, or enforcement actions taken in good faith, except to the extent such liability cannot be excluded or limited under applicable law.
Nothing in this Policy excludes or limits liability for fraud, willful misconduct, gross negligence, or any other liability that cannot be excluded or limited under applicable law.
9. Policy Updates
We may update this Copyright & Takedown Policy from time to time. The updated version will apply from its stated effective date.
